Zobie Auction Rules

By bidding on an auction lot, the user acknowledges that he/she has read and understood the following terms and conditions, and is in full agreement with such terms and conditions.

Terminology

The following terminology applies to these Terms and Conditions. “User,” “you,” or “your” shall refer to you. “Company,” “Zobie Productions,” “our,” or “we” shall refer to Zobie Productions. “Seller” or “consignor” shall refer to the party who owns the Lot and is placing the Lot up for auction. “Lot” or “Lots” shall refer to an item or set of items for sale in an auction.

The language in all parts of these Terms and Conditions shall in all cases be construed as a whole according to its fair meaning and not strictly for nor against any party. The neuter gender includes the masculine and feminine. It is mutually agreed that in the event any term, covenant, or condition herein contained is held to be invalid or void by any court of competent jurisdiction, the invalidity of any such term, covenant, or condition shall in no way affect any other term, covenant, or condition herein contained. Captions and paragraph headings used herein are for convenience only and are not a part of these Terms and Conditions and shall not be deemed to limit or alter any provisions hereof and shall not be deemed relevant in construing these Terms and Conditions.

Registration

All users must be 18 years of age or older and register to receive a User ID and Password to participate in the auction. Zobie Productions reserves the right to suspend the account of a user and/or cancel any bid for any reason.

Bidding

Once a bid is placed, it cannot be deleted. Our website requires a 2-step bidding confirmation process in order to eliminate the possibility of a bid error. Bids are accepted 24 hours a day directly through our website. Our site will automatically generate an send an e-mail when a user is outbid on an auction. Winning users will be notified as soon as possible via email. In order to ensure delivery of all of our emails, please add "email address" to your address book.

1. Bidding Increments

$0 - $99 - $1 increments

$100 - $199 - $2 increments

$200 - $499 - $2 increments

$500 and up - $5 increments

2. Buyer's Premium

A % service charge ("Buyer's Premium") will be added to the winning bid and is payable by the purchaser as part of the total purchase price to Zobie Productions. Currently, all weekly auctions have a 0% Buyer's Premium.

3. Minimum Bids & Reserves

Every lot within the auction has a minimum bid designated by our bidding increments. Some auction Lots may have a minimum price that we are willing to accept for that Lot to be sold at auction (“Reserve Price”). If bidding does not meet or exceed the Reserve Price, the Lot shall be returned to the consignor or relisted into a future auction (at the sole discretion of the Company). Currently, all weekly auctions do not have Reserve Prices.

4. Max Bids

When placing a max bid, you are instructing the auction house to competitively bid on your behalf up to (but not over) the given limit. These bids are kept in strict confidence. This type of bid is for your convenience.

5. Collusive Bidding

Bidding by consignors, collusive bidding, or shill bidding will not be permitted.

Payment & Non-Payment

In the event the user wins a lot, payment is due in full within 7 days after the auction ends. We accept all major debit and credit cards (Visa, MasterCard, American Express, and Discover) and PayPal. Failure to pay by the deadline will result in the suspension of auction privileges.

All amounts are displayed in United States Dollars (USD).

Shipping

Lots ship USPS, FedEx, and UPS for both domestic and international shipments. Estimated shipping costs can be displayed on the lot page. Most Lots are processed and shipped within 3-5 business days of Auction Invoice being paid in full.

Taxes & Fees

The winning bidder agrees that they will be responsible for the payment of any and all applicable taxes due in connection with the winning lot, including but not limited to sales tax, import fees, and duties.

Authenticity

Stock images may be used within an auction if multiple similar items are available to offer and if the item offered has the same autograph placement and quality. If a stock image is used, the item offered is guaranteed to be of equal or better quality. Because every hand-signed item is unique, the item received may vary slightly if a stock image was used.

Framed Items

Framed items are non-returnable due to frame damage.

While we make every effort to protect framed items while in our possession, we cannot be responsible for any damage to frames that may occur. If something was damaged in shipping, we will create a claim with the shipping company.

In the event we require additional authentication, Lots will be authenticated in-house by JSA. JSA is in our office regularly to authenticate Lots at discounted rates. Authentication fees start at $8 per Lot (not to exceed $150 per Lot). Zobie Productions will pay the authentication fee(s) initially and deduct the amount from the consignor’s account. There will be no authentication fee for Lots that do not pass the authentication process, and these Lots will be returned to the consignor. The consignor is responsible for the return shipping cost.

Zobie Productions is in no way responsible for any delay/s involving the 3rd party authenticators entering of authentication information nor is the aforementioned delay sufficient cause to cancel a winning bid and/or refusal to pay any amounts due to Zobie Productions.

Returns

Many items offered are hand-signed by celebrities and, therefore, have been handled by multiple parties in the process. For that reason, some handling wear should be expected.

1. If the lot was described correctly, then the lot is final sale.

2. If the lot was described extremely incorrectly, then the user must contact us within (7) days of the receipt of the lot with written explanation of the alleged misrepresentation.

Zobie Productions must be notified within (7) days of the receipt of the package of any damaged, missing, or incorrectly described items. Shipping charges are non-refundable, unless the lot is damaged or described incorrectly.
